Auto Liability Claim

The insured hauls building materials and construction supplies. An employee of the insured was driving an insured-owned tractor trailer when his truck overheated. He pulled off the road onto the side median to let the engine cool down. When re-entering the roadway, he built up speed while driving on the shoulder and merging into the right lane. His blinker and four-way flashers were on to indicate he was driving slowly. A secondary vehicle struck the rear of the tractor trailer as it was merging. The driver of the secondary vehicle sustained traumatic brain injuries and was in a coma for three months. Claimant also suffered rib fractures, respiratory failure and had a tracheotomy resulting in partial vocal cord paralysis. Total losses $8,622,000
